Welcome to Options in Personnel Pty Ltd, an online recruitment and learning platform with programme/s aimed at career development, job seeking and work readiness skills and related employment and work activities / skills.
By using Options in Personnel, you accept and agree to be bound by its terms and conditions as detailed below. Nothing contained in these Terms of Service (ToS) should be construed to confer any rights to any third party beneficiary.
Right to changes to user policy, terms and conditions
Goal2Work reserves the right to modify the Options service for any reason, without prior notice, without liability to the user or any other members or third party. The above right is also valid for termination of the service. Options in Personnel reserves its right to modify its user policy at any time, it is the user’s responsibility to evaluate the user policy regularly for changes.
Options in Personnel Access
Options in Personnel reserves the right to deny or grant access to its programmes and services, the user agrees that Options in Personnel’s decisions on access are final and binding.
Reasons for denying access may include but are not limited to: copyright or trademark infringement, improper or inappropriate use of services, any activity or action which may infringe upon other users rights.
Options in Personnel provides access to the online learning portal which is located on the internet, it is not responsible for the user’s ability to access the internet, this remains the user’s sole responsibility. (e.g. equipment required, data requirements)
Terms of service
The information, subject matter and content provided by Options in Personnel within the programme/s services has been fully developed and copyright by Options in Personnel and in the opinion of Options in Personnel and to the best of its knowledge, constitutes the correct information and methodology to be used to cover the subject matter / aims as described above. This information may change / need to be changed from time to time to reflect market changes / practices. The information may also differ from others and or the users own understanding or point of view on the subject matter.
Any action taken by the user on the basis of the information contained in Options in Personnel is the responsibility of the user alone, and Options in Personnel will not be liable in any manner or form for the consequences of such action taken by the user.
Should a user not understand or agree to the above the user should exit / not make use of the site.
Should the user make use of the site, any of its material and information this would imply and constitute the users full consent to this agreement and their intent to abide by its terms and conditions.
The user agrees to indemnify Option in Personnel from any claim in respect of subject matter, material, information and its correctness. Method of delivery, examples, opinions or errors.
The use of the service, its material, content and advice is at the user’s sole discretion. Options in Personnel does not make or imply any warranty regarding the availability of the site / service, correctness of information or advice, fitness for purpose, interruption or delay of service.
The user understands that the site and its contents, material is copyright and agrees not to copy, reproduce, re-sell, republish, upload, post, transmit or distribute any content or material without written consent from Options in Personnel. The user may not reproduce or copy any material on the Options in Personnel site in any form whatsoever except where worksheets and exercises are provided for download and use within the ambit of the programmes and then only for personal, non-commercial use.
The use of the service, its material and content is at the user’s sole discretion.
Password and access security
The user understands that their user login data including user name and password are for their sole use and that the security of their login is their sole responsibility.
The user undertakes to do everything possible and take all reasonable steps to keep their login details confidential. The user agrees that they will be held solely responsible for any activity on the site occurring under their login details.
Options in Personnel reserves the right to suspend the users access to the site should there be any confirmation or suspicion that their login details have been / are being used by a third party.
Prohibited acts and / or conduct
Options in Personnel may not be used by a user for illegal, prohibited, unauthorised acts.
Options in Personnel is a South African company and complies with legal requirements of South Africa; it is the user’s responsibility to ensure they are aware of and abide by the laws which are relevant to their area / country and to ensure that they comply with these at all times. Options in Personnel accepts no responsibility for the conduct and breach of any rules / laws by any user.
Options in Personnel reserves the right to evaluate and remove any content or information (user or otherwise) from the site at their sole discretion should they deem the content / information to be in violation of any law or act and / or be inaccurate, defamatory, obscene, harassing, racist, abusive or objectionable to Options in Personnel or another user in any form.
Any communication or information disseminated between users and / or between users and Options in Personnel which may be allowed via the site in any format (e.g. forums) must be kept professional and within the topic of the site and its programmes; Career Development, Job Search, Work Readiness, Employment, Recruitment. Information, communication or content not in keeping with this may be removed as per the above rights.
Should any user become aware or be exposed to any information, content, behaviour as described above and via the Options in Personnel web facilities they should immediately contact Options in Personnel who will deal with the matter according to its sole rights as described in this policy. Users acknowledge that by using the service they may be exposed to this information, content, behaviour via other users and understand that Options in Personnel accepts no liability in any form arising from this exposure.
Limitation of liability
Under no circumstances will Options in Personnel be liable to the user for any direct or indirect, incidental, consequential, special or exemplary damage arising out of or in connection with the use of Options in Personnel and its services. The user accordingly indemnifies Options in Personnel from any claim.
Options in Personnel shall have no liability to the user for any matters where it has no control or which are beyond its control and fall into the commonly understood definition of Force Majeure.
These Terms of Service constitute the entire agreement between the parties with respect to the subject matter thereof and supersedes and replaces all prior understandings or agreements, written or oral, regarding such subject.
These Terms of Service will be governed by and construed in accordance with the laws of South Africa and any dispute arising out of the use of the site shall be subject to the exclusive jurisdiction of courts, South Africa.
